Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the services provided by Apex Cloud Host LLC ("Apex Cloud Host", "we", "us") through apexvds.com (the "Service"). By creating an account, placing an order, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

Apex Cloud Host provides virtual private servers (VPS) and virtual dedicated servers (VDS) across the Bronze, Silver, and Gold tiers, provisioned automatically upon successful payment. Specifications, available locations, and operating systems for each plan are described on our pricing page and may be updated from time to time.

Servers are provisioned on infrastructure operated in partnership with our upstream infrastructure providers. While we manage billing, provisioning, and support directly, availability of any given location or plan is subject to upstream capacity.

3. Account Registration & Security

You must provide accurate information when registering and keep your account credentials confidential. You are responsible for all activity that occurs under your account, including actions taken by anyone you grant access to. Notify us immediately at the support address below if you suspect unauthorized access.

• You must be at least 18 years old to create an account.
• One account per individual or legal entity unless otherwise agreed in writing.
• We may require additional verification for high-value orders or suspected fraud.

4. Billing, Wallet & Payments

Plans are billed on a recurring monthly basis at the rate shown at checkout. Payment is accepted via cryptocurrency. You may also maintain a wallet balance, which is used automatically for renewals so your service is not interrupted.

Prices may change for future billing cycles; we will make reasonable efforts to notify active customers of pricing changes in advance. Failure to pay for a renewal by the due date may result in suspension and, after a grace period, termination and data loss.

5. Provisioning & Service Availability

Servers are provisioned automatically, typically within minutes of a payment being confirmed. Our target uptime and provisioning commitments are set out in our Service Level Agreement, which forms part of these Terms.

6. Acceptable Use

Use of the Service is subject to our Acceptable Use Policy. Violations may result in a warning, suspension, or immediate termination without refund, depending on severity, at our sole discretion.

7. Suspension & Termination

We may suspend or terminate your access to the Service if you violate these Terms, our Acceptable Use Policy, fail to pay for a renewal, or if we reasonably suspect fraudulent activity. You may cancel your service at any time from your dashboard; cancellation stops future renewals but does not entitle you to a refund for the current billing period except as described in our Refund Policy.

Upon termination, we may permanently delete server data. We recommend maintaining your own backups at all times — we are not responsible for data loss.

8. Refunds

Refund eligibility is governed by our Refund Policy, which is incorporated into these Terms by reference.

9. Limitation of Liability

To the maximum extent permitted by law, Apex Cloud Host LLC and its officers, employees, and infrastructure partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the three (3) months preceding the event giving rise to the claim.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email or an in-app notice at least 7 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which Apex Cloud Host LLC is registered, without regard to conflict-of-law principles, unless otherwise required by applicable consumer protection law in your jurisdiction.
